Terms of Service for Likhoto™

1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of Likhoto™ ("Likhoto", the "Service", or the "Application"), provided by Shyamol Private Limited.

By creating an account, accessing, or using Likhoto, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, you must not create an account or use Likhoto.

2. About Likhoto

Likhoto is a medical practice records application designed for doctors and authorized clinic staff working in clinics and medical practices.

The Service may allow authorized users to capture, organize, store, search, and access medical practice records, patient information, uploaded files, notes, and appointments.

Likhoto is designed as a record-keeping and organizational system. It is not a hospital information system and is not intended to replace systems independently operated by hospitals or other healthcare institutions.

3. Eligibility and Authorized Use

Likhoto is intended for use by doctors, healthcare professionals, clinic owners, and authorized clinic staff.

You must provide accurate information when creating your account and must keep your account information reasonably current.

You are responsible for ensuring that you are authorized to access and use the patient, clinic, and other information that you enter into Likhoto.

You may not use Likhoto if doing so would violate the laws, regulations, professional obligations, confidentiality duties, or contractual obligations applicable to you.

4. Accounts and Account Security

Certain features of Likhoto require an account. You are responsible for maintaining the confidentiality of your account credentials and for activities carried out through your account.

You must notify us promptly if you believe your account, credentials, or authentication information has been compromised or accessed without authorization.

You must not share your account credentials with unauthorized persons or permit another person to use your account in a manner that violates these Terms.

5. Clinic Workspaces and User Roles

Likhoto may allow doctors and authorized staff to work within clinic workspaces. Access to information may depend on the user's role, clinic membership, and permissions configured within Likhoto.

Doctors and clinic administrators are responsible for managing who is granted access to their clinic workspace and for removing access when a person is no longer authorized to use the workspace.

Where multiple doctors use the same clinic, records may remain associated with the relevant doctor and permissions rather than being automatically visible to every doctor in the clinic.

6. Medical Records and Patient Information

Likhoto allows authorized users to enter and upload patient information and medical records for professional record-keeping purposes.

You are responsible for ensuring that you have the right and lawful basis to collect, use, upload, store, and otherwise process patient information through Likhoto.

You are also responsible for obtaining any notices, consents, authorizations, or permissions required by the laws and professional standards applicable to your practice.

Likhoto does not determine whether a particular record should be created, retained, disclosed, or deleted. Those decisions remain the responsibility of the relevant healthcare professional or organization.

7. Medical Disclaimer

Likhoto is a medical practice record-keeping and organizational application. It is not a medical device and does not diagnose, treat, cure, or prevent any medical condition.

Likhoto does not provide medical advice, diagnosis, treatment recommendations, or clinical decision support.

Healthcare professionals remain solely responsible for their professional judgment, patient care, diagnosis, treatment, prescriptions, and other clinical decisions.

Likhoto should not be relied upon as the sole source of information for an emergency or other situation requiring immediate medical attention.

8. Your Content and Responsibility

You retain control over the information and records that you enter into Likhoto, subject to applicable law and the contractual relationship under which the information is processed.

You are responsible for the accuracy, completeness, legality, and appropriateness of information and files you submit, upload, or otherwise store through the Service.

You must not upload content that you are not authorized to possess, process, or store.

9. Prohibited Use

You must not use Likhoto to:

• violate applicable laws, regulations, or professional obligations;
• access another person's account or information without authorization;
• upload malicious code, malware, or other harmful content;
• attempt to bypass authentication, authorization, security, or access controls;
• interfere with or disrupt the operation of the Service or its infrastructure;
• reverse engineer, decompile, or attempt to extract source code except where expressly permitted by applicable law;
• use the Service to build, benchmark, or operate a competing service through unauthorized automated access;
• use Likhoto for unlawful, fraudulent, abusive, or harmful activity.

10. Subscriptions and Billing

Certain features of Likhoto are provided through paid subscriptions. Subscription pricing, billing period, available plans, introductory offers, and applicable taxes may vary by country or region.

Android subscriptions purchased through Likhoto are processed using Google Play Billing. Your purchase is also subject to the applicable Google Play terms, policies, and payment terms.

Your subscription may renew automatically unless canceled in accordance with the applicable Google Play subscription settings and terms.

You can manage or cancel a Google Play subscription through the Google Play subscription management interface. Google Play generally continues the subscription through the current billing period after cancellation, subject to applicable regional law and the terms applicable to the transaction.

Subscription upgrades, downgrades, renewals, cancellations, refunds, and billing adjustments may be subject to Google Play rules and applicable law. Refund availability can vary depending on your location and the circumstances of the purchase.

11. Trials and Promotional Offers

Likhoto may occasionally offer free trials or other promotional subscription offers. Any applicable eligibility requirements, duration, pricing after the promotional period, and renewal terms will be presented at the time the offer is made.

Unless otherwise stated in the applicable offer, a subscription that converts from a trial or promotional period may renew at the then-applicable recurring price until canceled.

12. Changes to Subscriptions and Pricing

We may introduce, modify, discontinue, or change subscription plans and pricing from time to time.

Where changes affect an existing subscription, we will provide any notice required by applicable law or the platform through which the subscription was purchased.

Changes to a subscription plan may take effect immediately or at the next applicable billing period depending on the type of change, the billing platform, and the applicable rules.

13. Beta and Closed Testing

While Likhoto is in closed or private testing, the Service may be provided as a beta or pre-release product.

Beta features may be changed, removed, temporarily unavailable, or behave differently from the final version. We may modify testing environments, limits, plans, features, or availability during testing.

You acknowledge that beta software may contain defects or unexpected behavior and that certain functionality may not yet be available in its final form.

Unless otherwise expressly stated, no service-level agreement, uptime commitment, or guarantee of uninterrupted availability applies during closed or beta testing.

14. Service Availability and Changes

We may modify, suspend, restrict, or discontinue all or part of Likhoto for maintenance, security, technical, business, or legal reasons.

We will make reasonable efforts to maintain the Service, but we do not guarantee that Likhoto will always be available, uninterrupted, error-free, or compatible with every device or environment.

15. Data Security and Privacy

Our collection and handling of personal information is described in our Privacy Policy.

We implement technical and organizational measures designed to protect information processed through Likhoto. However, no electronic system can be guaranteed to be completely secure.

16. Intellectual Property

Likhoto, including its software, user interface, visual design, branding, trademarks, logos, documentation, and other proprietary materials, is owned by or licensed to Shyamol Private Limited and is protected by applicable intellectual property laws.

These Terms grant you a limited, non-exclusive, non-transferable, revocable right to use Likhoto for its intended purpose during the period in which you are authorized to use the Service.

Except as expressly permitted by law or these Terms, you may not copy, modify, distribute, sell, license, lease, or create derivative works from Likhoto or its proprietary materials.

17. Feedback

If you voluntarily provide suggestions, ideas, bug reports, feature requests, or other feedback about Likhoto, you grant Shyamol Private Limited permission to use that feedback to improve the Service without obligation to pay you.

We will not use confidential patient information you submit merely as part of a support request for unrelated marketing or promotional purposes.

18. Termination and Suspension

You may stop using Likhoto at any time and may request deletion of your account in accordance with our Privacy Policy.

We may suspend or terminate access to an account or the Service where reasonably necessary to protect the Service, investigate abuse or security issues, enforce these Terms, comply with law, address non-payment, or prevent unauthorized use.

Where required by applicable law, we will provide notice or other procedural protections before or after suspension or termination.

Termination does not automatically cancel a Google Play subscription. Where applicable, subscription cancellation must be completed through Google Play.

19. No Warranties

To the maximum extent permitted by applicable law, Likhoto is provided on an "as available" and "as is" basis.

We do not guarantee that the Service will always be available, uninterrupted, secure, completely accurate, or free of errors or defects.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded under the laws applicable to you.

20. Limitation of Liability

To the maximum extent permitted by applicable law, Shyamol Private Limited and its officers, directors, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of Likhoto.

This includes, where permitted by law, losses arising from interruption of service, loss of business opportunity, loss of profits, or reliance on the Service.

Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law, including liability that may not lawfully be excluded for fraud, willful misconduct, or certain personal injury or consumer rights.

21. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Shyamol Private Limited and its officers, directors, employees, and service providers from claims, losses, liabilities, and expenses arising from:

• your violation of these Terms;
• your unauthorized use of Likhoto;
• information or files you submit or upload unlawfully; or
• your violation of applicable laws or third-party rights.

22. International Users and Applicable Law

Likhoto may be available in multiple countries. You are responsible for ensuring that your use of the Service complies with the laws and professional requirements applicable to you.

Nothing in these Terms is intended to remove or limit mandatory rights or protections that apply to consumers or users under the laws of the country or region where those rights apply.

Except where mandatory local law requires otherwise, these Terms are governed by the laws of India, without regard to conflict-of-law principles.

23. Changes to These Terms

We may update these Terms from time to time to reflect changes to Likhoto, our business, legal requirements, or applicable policies.

When material changes are made, we will update the "Last Updated" date and, where required by applicable law, provide additional notice.

Your continued use of Likhoto after the effective date of updated Terms constitutes acceptance of the updated Terms to the extent permitted by applicable law.

24. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms presented to you for specific features or services, constitute the agreement between you and Shyamol Private Limited concerning your use of Likhoto.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by applicable law.
